1. Acceptance of Terms
By accessing and using Musiate, you accept and agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our service.
2. Description of Service
Musiate is a curated music discovery platform that provides random music recommendations based on user preferences. We offer both free discovery features and premium paid services for artists. We also collect anonymous usage analytics to improve our service and provide personalized experiences for users with accounts.
3. User Accounts and Registration
3.1 Account Creation
- User Accounts: Users may create accounts to track their music discovery preferences and personalize their experience
- Admin Accounts: Created by Musiate for authorized personnel only
- Optional Registration: Basic discovery features are available without registration
3.2 Account Requirements
- You must provide a unique username
- Email address is optional but recommended for account recovery
- You must create a secure password meeting our requirements
- You are responsible for maintaining the confidentiality of your account credentials
- You are responsible for all activities under your account
3.3 Account Recovery
Important: If you do not provide an email address during registration, we cannot recover your account if you forget your password. Your account will be permanently inaccessible.
4. User Account Features and Responsibilities
4.1 Artist Preference Tracking
- You may mark artists as "listened" to exclude them from future discovery recommendations
- You may mark artists as "hidden" to completely exclude them from your discovery experience
- These preferences are stored in your account and used to personalize your experience
- You can modify or remove these preferences at any time
4.2 Account Data and Privacy
- Your username may be visible in certain contexts but personal preferences remain private
- Your artist interaction data is used solely to improve your personal discovery experience
- We do not share individual user preferences with artists or third parties
- You may delete your account and all associated data at any time
- Login sessions are maintained for up to 30 days for your convenience, but you can log out at any time
4.3 Account Termination
- You may delete your account at any time through your account settings
- We may suspend or terminate accounts that violate these terms
- Upon account deletion, all your preferences and account data will be permanently removed
5. Premium Services for Artists
5.1 Standard Premium Plan (€3/month per artist, excluding taxes)
- Up to 3 custom URL fields on artist profiles
- Basic data insights including click statistics and user engagement metrics

5.2 Priority Plan (€1 per entry (artist), excluding taxes)
- Add any artist within 24 hours
- No recurring costs

- Custom filter tags for artists
- Pricing based on number of entries
- Monthly billing

5.4 Payment Terms
- Payments are processed monthly in advance
- All prices exclude applicable taxes
- We reserve the right to change pricing with 30 days notice
- No refunds for partial months
5.5 Analytics and Performance Data for Premium Plans
- Premium plan subscribers receive access to anonymized analytics data about their content performance on our platform
- This includes aggregated click statistics, platform preferences, and discovery metrics
- All data provided is anonymized and aggregated - no individual user information is shared
- We may share performance insights to help artists understand their audience engagement on our platform
- Analytics data is provided for the purpose of helping artists optimize their presence and understand fan preferences
- User Privacy: Individual user preferences (listened/hidden status) are never shared with artists or included in analytics reports
6. Donations
6.1 Voluntary Nature
All donations to Musiate are voluntary and made to support the operation and development of our free music discovery platform.
6.2 Donation Processing
- Third-Party Processing: All donations are processed through PayPal, a third-party payment processor
- PayPal Terms: Donations are subject to PayPal's terms of service and privacy policy
- Transaction Fees: PayPal may deduct processing fees from donations
- Currency: Donations are processed in USD unless otherwise specified
6.3 Use of Donations
Donations are used to:
- Cover hosting and infrastructure costs
- Support platform development and improvements
- Add new artists and content to our database
- Maintain and enhance user experience
- Keep the platform free and ad-free
6.4 No Goods or Services
Donations do not entitle donors to:
- Special access or premium features
- Preferential treatment or priority support
- Influence over platform decisions or content
- Refunds or exchanges (donations are final)
- Tax deductions (Musiate is not a registered charity)
6.5 Refund Policy
Donations are generally final and non-refundable. However:
- Technical errors or duplicate charges may be reviewed on a case-by-case basis
- Refund requests must be made within 30 days of the donation
- All refunds are processed through PayPal according to their policies
- We reserve the right to refuse refunds for donations made in bad faith
6.6 Donor Recognition
Unless you explicitly request recognition:
- All donations are treated as anonymous
- Donor names and amounts are not published or shared
- We do not maintain public donor lists or acknowledgments
7. Acceptable Use
7.1 Prohibited Activities
You may not:
- Use the service for illegal purposes
- Upload or link to copyrighted material without permission
- Attempt to gain unauthorized access to our systems or other user accounts
- Interfere with the proper functioning of the service
- Submit false or misleading information
- Spam or harass other users
- Create multiple accounts to circumvent artist preference limitations
- Attempt to circumvent or interfere with our tracking and analytics systems
- Use automated tools to scrape data or overload our servers
- Abuse the artist preference system to manipulate discovery algorithms
7.2 Content Standards
- All submitted content must be accurate and truthful
- Music content must comply with copyright laws
- User-generated content (usernames, preferences) must not be offensive or inappropriate
- We reserve the right to remove any inappropriate content or terminate accounts for violations
7.3 Account Usage Standards
- One account per person
- Accounts must not be shared or transferred
- Artist preferences should reflect genuine listening interests
- Do not create accounts solely to manipulate our recommendation system
8. Data Collection and Analytics
8.1 Anonymous Usage Tracking
By using our service, you acknowledge and agree that we collect usage data including:
- Click interactions with streaming links and website features
- Navigation patterns and content preferences
- Discovery feature usage and filter selections
- Technical information for service optimization
8.2 Account-Linked Data Collection
For users with accounts, we also collect:
- Artist interaction preferences (listened/hidden status)
- Discovery history and personalization data
- Account activity and preference changes
- Login patterns and session information
8.3 Purpose of Data Collection
We use this data to:
- Improve our music discovery algorithms and recommendations
- Optimize website performance and user experience
- Understand content preferences and popular features
- Ensure the proper functioning of our platform
- Provide personalized experiences for account holders
- Generate anonymized analytics for premium subscribers

All tracking data is collected in accordance with our Privacy Policy. For users without accounts, data remains anonymous. For account holders, data is linked to your account to provide personalization but individual preferences are never shared with third parties.
9. Intellectual Property

The Musiate platform, including its design, features, curated database, discovery algorithms, and analytics systems, is owned by us and protected by copyright and other intellectual property laws.
9.2 User Content
You retain ownership of content you submit (usernames, preferences), but grant us a license to use this information to provide and improve our services.
9.3 Music Content
We provide links to third-party streaming platforms. We do not host or own the music content itself.
9.4 Analytics and Usage Data
Usage patterns and analytics data generated through your use of our service may be used by us for service improvement and operational purposes.

11. Disclaimers and Limitations
11.1 Service Availability
We strive to maintain service availability but do not guarantee uninterrupted access. We may suspend service for maintenance or other reasons.

While we curate our music database carefully, we do not guarantee the accuracy or completeness of all information.
11.3 Third-Party Links
We are not responsible for content on third-party websites linked from our platform. When you click streaming links, you leave our platform and enter the terms and privacy policies of those services.
11.4 Personalization Accuracy
While we strive to provide accurate personalized recommendations based on your preferences, we do not guarantee the precision or completeness of our recommendation algorithms.
11.5 Account Recovery
We are not responsible for permanent account loss due to forgotten passwords when no recovery email is provided.
12. Limitation of Liability
To the maximum extent permitted by law, Musiate shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the service, including but not limited to issues related to data collection, analytics, account management, or third-party integrations.
13. Indemnification
You agree to indemnify and hold harmless Musiate from any claims, damages, or expenses arising from your use of the service, violation of these terms, or misuse of account features.
14. Termination
14.1 By You
- You may cancel premium subscriptions at any time. Cancellations take effect at the end of the current billing period
- You may delete your user account at any time, which will permanently remove all your data
- You can opt out of analytics tracking at any time through our cookie preferences
14.2 By Us
We may terminate or suspend your access immediately for violations of these terms or for any other reason at our discretion.
15. Governing Law
These terms are governed by the laws of the Netherlands. Any disputes will be resolved in the courts of the Netherlands.
16. Changes to Terms
We may update these Terms of Service from time to time. We will notify users of significant changes by posting the updated terms on our website. Changes to our data collection practices or account features will be clearly highlighted.
